California Vehicle Code § 23103 VC prohibits reckless driving, defined as operating a motor vehicle with a willful or wanton disregard for the safety of other people or property.

Under California Vehicle Code Section 23103: “A person who drives a vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.”

To convict you under CVC §23103 (a), the prosecutor must prove the following beyond a reasonable doubt: Intention: You intended to drive as you did. Note: The fact that you “drove faster than the legal speed limit” doesn't mean you “drove with wanton disregard for safety.”

Reckless driving itself is defined as driving “a vehicle upon a highway in willful or wanton disregard for the safety of persons or property…” Under subsection (b) of California Vehicle Code § 23103, this crime can be committed also in an off-street parking facility.
