FMVSS are divided into three categories: crash avoidance (100-series), crashworthiness (200-series), and post-crash survivability (300-series). The first regulation, FMVSS No. 209, was adopted on 1 March 1967 and remains in force to date though its requirements have been periodically updated and made more stringent.

If a vehicle now outside the U.S. bears a certification label affixed by its original manufacturer stating that the vehicle complies with all applicable FMVSS in effect on its date of manufacture, it can be imported as a conforming motor vehicle under Box 2A on the HS-7 Declaration form that must be given to Customs at the time of entry.

However, for trucks and multipurpose passenger vehicles with a gross vehicle weight rating greater than 10,000 lbs, police vehicles as defined in S7 of FMVSS No. 208, firefighting vehicles, ambulances, and motor homes, a seating location that is labeled in accordance with S4.4 of FMVSS No. 207 will not be considered a designated seating position.
