In Jabba's palace, Luke uses the choke briefly in self defence, not to cause lasting harm or death, not to cause fear, but to protect himself. This is no more of the dark side than Yoda slamming the two Imperial guards into the door frame in the Chancellor's office.

We are shown this in the beginning of ROTJ to see how much his powers have grown, but also with them his arrogance about his powers. He will learn to temper that by the time he becomes a Jedi.
