
Senate Bill (SB) 9 (Chapter 162, Statutes of 2021) requires ministerial approval of a housing development with no more than two primary units in a single-family zone, the subdivision of a parcel in a single-family zone into two parcels, or both.

Senate Bill 9 (SB 9) is a new California State Law taking effect January 1, 2022. SB 9 changes existing limits on how many homes can be built on a lot zoned as single-family.
The State of California passed SB9 as one of a set of measures to address the housing crisis in California. Since 2022, SB 9 has facilitated the construction of additional units on parcels zoned for single-family residential use, streamlining and simplifying the process.

SB 9 makes two important changes to state law: It allows two homes to be built on each of those lots, with the effect of legalizing fourplexes in areas that previously only allowed one home. SB 9 contains important protections against the displacement of existing tenants.

SB 9 provides for the subdivision of an existing lot into two new parcels in the Single-Family Zones. This is called an Urban Lot Split, and requires owner occupancy. Urban lot splits may be combined with two-unit developments, ADUs and JADUs for the construction of up to two units on each new parcel resulting from the lot split.
