The Work Health and Safety Amendment Act 2023, recently passed by the NSW Parliament has enacted the following changes to NSW Work Health and Safety (WHS) laws. Incorporating amendments made to the model WHS Act, such as:

Employers and business have specific legal obligations under WHS law. Workers have health and safety obligations under WHS law. All medical practitioners have an obligation to report any diagnoses of a case of asbestosis or silicosis in NSW. Anyone visiting a workplace has health and safety responsibilities.

The Work Health and Safety (WHS) Regulation (the Regulation) applies to all NSW workplaces to protect workers from risks to their health and safety. The current Regulation ends on 1 September 2025 unless it is remade, with or without changes.

2024年8月8日 · Businesses have the primary responsibility for ensuring the health and safety of everyone in their workplace under NSW’s work health and safety (WHS) laws. This includes a positive duty to take all reasonable steps to eliminate or minimise both physical and psychological risks to health and safety including the risk of sexual harassment.

The WHS legislation applies to all workplaces in NSW, including mines. The Work Health and Safety Act 2011 came into effect on 1 January 2012 and the Work Health and Safety Regulation 2017 commenced on 1 September 2017.

A code of practice provides detailed information on how you can achieve the standards required under the work health and safety (WHS) laws. These do not replace the WHS laws, but codes of practice can be issued to help make understanding what you have to do a little easier.
