Employers and business have specific legal obligations under WHS law. Workers have health and safety obligations under WHS law. The Work Health and Safety (WHS) Regulation (the Regulation) applies to all NSW workplaces to protect workers from risks to their health and safety. The current Regulation ends on 1 September 2025 unless it is remade, with or without changes.

This includes a positive duty to take all reasonable steps to eliminate or minimise both physical and psychological risks to health and safety including the risk of sexual harassment.

The WHS legislation applies to all workplaces in NSW, including mines. The Work Health and Safety Act 2011 came into effect on 1 January 2012 and the Work Health and Safety Regulation 2017 commenced on 1 September 2017.
