When submitting the form to USCIS, please sign and submit a fully executed copy of page 2 along with Form ETA-9089 and the appropriate appendices. PERM applications submitted to OFLC will receive an electronic version of this form if the application is certified.

DOL processes Applications for Permanent Employment Certification, ETA Form 9089, with the exception of Schedule A and sheepherder applications filed under 20 CFR § 656.16. The date the labor certification application is received by the DOL is known as the filing date and is used by USCIS and the Department of State as the priority date.

After that, the employer will have to complete a labor certification, commonly known as PERM (Program Electronic Review Management), on your behalf to obtain an EB-2 or EB-3 visa immigrant visa. PERM was implemented on March 28, 2005.

A permanent labor certification issued by the Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the United States.
