2024年3月11日 · The VA Failed to fully meet it's Duty to Assist - if you can convince them this happened you get a "Do Over" i.e. the VA drops back 20 and Punts the ball to a Secondary claim where you go back to another C&P Since your HLR is soon and you don't know what the VA did or what is in your file you are at their mercy. All is not lost.
HLR closed today; however, I am confused by the wording.

So, I submitted an HLR to basically claim service connection. I had a vasovagal syncope (passed out), and hit my head, was MEDIVAC’d (in Afghanistan). When I submitted another claim, the VA added the claim, not me. They ended up denying it and not service connecting. As you mentioned, the HLR got closed and a DTA opened.

I canceled mine at the attorneys request that is handling my claims. Then the HLR kicked 2 claims back to the VA with Duty to assist and listed the specific dates in my records that they over looked. The reviewer also SC my tinnitus and got 10%. Now just waiting for them reviews to finish up that got kicked back.

2021年10月26日 · The HLR rep will deny your claim. You just need to wait it out and see what happens. You can go into your disabilities page and see if the HLR rep signed off on your claim by checking the percentage level of your claimed disability/disability increase. My HLR, that was two years ago, went with the first and second choices above.
